Can I Get an Abortion in Texas?
It’s been a year since the overturn of Roe v. Wade. But it can still be confusing to figure out what that means for you when you are unexpectedly pregnant and considering abortion. Dealing with an unplanned pregnancy is stressful enough without trying to figure out what’s true about your options. So, here are what your rights in Texas are (as of May, 2023).
What did the overturn of Roe v. Wade in 2022 actually do to abortion laws?
The overturn of Roe v. Wade did NOT make abortion illegal throughout the US; it allowed each state to enact specific laws regarding abortions.
So, what about Texas Laws?
In Texas, abortion is illegal unless the mother’s life is at risk or maintaining the pregnancy will cause serious long-term harm to her health. A woman who seeks or obtains an abortion (or a woman who has previously had an abortion) CANNOT be prosecuted.
Will I still get medical care if I miscarry?
A miscarriage is NOT an abortion. A woman will NOT be denied medical care for a miscarriage. Also, treatment for an ectopic pregnancy is NOT affected by Texas abortion law. It is critically important to have an ultrasound early in the pregnancy to rule out an ectopic pregnancy.
Does that include the abortion pill?
Taking abortion pills or having a surgical abortion will both terminate your pregnancy. Both types of abortion are illegal in Texas. It is ILLEGAL for abortion pills to be distributed within the state of Texas or mailed to Texas.
What about Plan B?
Texas abortion laws do NOT restrict access to emergency contraception or birth control. To make an informed decision about your pregnancy, you are advised to schedule an ultrasound to learn how far along you are.
